D.S.C.: Issuing magistrate sharing address with LE agency doesn’t make not “neutral and detached”

The issuing magistrate is not shown to be an adjunct law enforcement officer just because the judge shares and address with a police department. Martinez v. Wilson, 2025 U.S. Dist. LEXIS 268655 (D.S.C. Dec. 10, 2025).

The search incident of defendant’s person at the time of his arrest was reasonable. The body cam also showed why a protective sweep of his motel room was valid: there was someone in the bathroom. State v. Brooks, 2025 La. App. LEXIS 2556 (La. App. 5 Cir Dec. 29, 2025).*

Officers in your house for execution of a search warrant who follow you around for safety purposes have not necessarily curtailed your freedom of movement. United States v. Coffelt, 2025 U.S. Dist. LEXIS 268383 (W.D.N.Y. Dec. 31, 2025).*
