DE: SW needed for hospital medical records; subpoena production suppressed

Implicit in prior case law is that a search warrant is required for medical records in Delaware. The state’s obtaining defendant’s by subpoena is suppressed. State v. Robinson, 2015 Del. C.P. LEXIS 32 (May 15, 2015).

Defendant consented to entry into his hotel room by the police. The court credits a hallway surveillance video and not the defendant who said the officers came in and rousted him from bed. United States v. King, 2015 U.S. Dist. LEXIS 79915 (E.D.Va. June 19, 2015).*

The warrantless search of defendant’s cell phone five years before Riley was valid under Davis good faith. United States v. Gary, 2015 U.S. App. LEXIS 10381 (7th Cir. June 19, 2015).*
