Under Idaho law, the fact a gun was unloaded made it not a concealed weapon, and the officer’s observation that it was unloaded dispelled RS on that score. Nevertheless, defendant’s lethargy and confusion warranted detaining him to figure out what was wrong with him. State v. Cutler, 141 P.3d 1166 (Ida. App. July 14, 2006).
