Probation search extends to friend’s jacket

Officer’s subjective motivation for probation search is irrelevant under Knights. Probation search extends to the jacket of a third party staying with probationer because of possibility that the probationer could secrete contraband in pockets of third party. United States v. Santana, 2006 U.S. Dist. LEXIS 56008 (D. Me. August 10, 2006).

In an environmental case over a Superfund site, a state search warrant was issued, and the RI environmental authorities filed a motion to dismiss. The district court held that Younger abstention did not yet apply because there was no state action, as defined by state law, to yet enjoin. Rhode Island Resource Recovery Corp. v.
