CA3: Municipal officers may execute federal PV warrants

Defendant was ID’d as a likely suspect in a bank robbery, and a federal probation violation warrant was issued. Municipal officers may execute federal probation violation warrants. “See, e.g., United States v. Polito, 583 F.2d 48, 51 (2d Cir. 1978); United States v. Bowdach, 561 F.2d 1160, 1167-68 (5th Cir. 1977).” United States v. Osorio, 2018 U.S. App. LEXIS 35911 (3d Cir. Dec. 20, 2018).

Where the trash containers were at the time of the trash search was a question of fact resolved by the trial court against the defendant based on the testimony of officers and a neighbor. It has evidentiary support and cannot be overturned. State v. Quintero, 2018-Ohio-5145, 2018 Ohio App. LEXIS 5454 (10th Dist. Dec. 20, 2018).*
