M.D.Ala.: A “level III inspection” of a tractor trailer by the Motor Carrier Safety Unit of the Alabama State Police was valid and led to RS then PC

A “level III inspection” of a tractor trailer by the Motor Carrier Safety Unit of the Alabama State Police led to looking at the load and seeing that something was wrong, and that led to finding marijuana. The stop and inspection were both valid. The opening of the truck led to reasonable suspicion. United States v. Cruz, 2017 U.S. Dist. LEXIS 68186 (M.D. April 17, 2017), adopted, 2017 U.S. Dist. LEXIS 67267 (M.D. Ala. May 3, 2017).

Defendant’s hesitation before consenting to the entry into his house indicates that he knew he had the right to refuse and elected not to. The totality shows that the consent to search his person and the house once inside was also voluntary. United States v. Doss, 2017 U.S. Dist. LEXIS 68175 (W.D.Ky. May 4, 2017).*
