CA2: Murder scene entry resulted in valid protective sweep and plain view

NYPD’s crime scene entry at the scene of a murder and protective sweep were all valid because of the exigency of the entry. Drug and other evidence was in plain view. [There are no facts talking about standing, or whether it was even an issue.] United States v. Lee, 2016 U.S. App. LEXIS 15542 (2d Cir. Aug. 24, 2016).

After the patrol car lights came on, defendant drove several blocks and made four turns before he stopped at a gas station. The traffic offense was reasonable suspicion, and the failure to stop only added to it. The patdown was reasonable and it produced a gun and body armor, and he was a convicted violent felon. [Defendant was acquitted of the gun, but not the body armor.] United States v. McPhaul, 2016 U.S. App. LEXIS 15826 (7th Cir. Aug. 26, 2016).*
