MO: A search warrant for a residence includes buildings and vehicles on the curtilage

A search warrant for a residence includes buildings and vehicles on the curtilage. “The warrant also indicated that the residence has a basement, a two-car detached garage, and a wood-burning fireplace. The record indicates that the detached garage is located within ten feet from the residence and that the wood-burning furnace is ‘fairly close’ to the residence. The record also indicates that both structures are connected to the residence through electrical wiring, and that the furnace has underground pipes or ducts connecting it to the house to provide heat.” State v. Walter, 2014 Mo. App. LEXIS 1130 (October 7, 2014).

An injured defendant voluntarily consented to a blood draw just before receiving a blood transfusion in the hospital after having blood drawn for medical reasons. The coming blood transfusion was an exigent circumstance, too. State v. Fortner, 2014 Mo. App. LEXIS 1113 (October 7, 2014).*

The inventory of defendant’s wallet on his arrest was valid. Two credit cards were found with pieces of tape attached that had handwriting. That suggested to the officer credit card fraud and he consulted another officer. United States v. Bell, 2014 U.S. App. LEXIS 19080 (11th Cir. October 7, 2014).*
