E.D.N.C.: NC law requires RS for a supervision search, and here it’s lacking

North Carolina law requires reasonable suspicion for a supervision search, and here it was completely lacking. The motion to suppress is granted. United States v. Fuller, 2019 U.S. Dist. LEXIS 202240 (E.D. N.C. Oct. 1, 2019).*

State statute discusses concealed carry, and the officer had probable cause to believe that defendant wasn’t concealing the gun he could see. People v. Balark, 2019 IL App (1st) 171626, 2019 Ill. App. LEXIS 902 (Nov. 20, 2019).*

The stop was justified because the officers ran the LPN and found it was uninsured. After the stop, the court finds that defendants consented to a search of the car. United States v. Lawrence, 2019 U.S. Dist. LEXIS 201984 (E.D. Mich. Nov. 21, 2019).*
