D.Nev.: Def’s stop for jaywalking at an uncontrolled intersection didn’t justify his patdown for weapons

Defendant’s stop for jaywalking at an uncontrolled intersection didn’t justify his patdown for weapons. United States v. Jacobs, 2019 U.S. Dist. LEXIS 70241 (D. Nev. Apr. 25, 2019).

Summary judgment for existence of probable cause in a § 1983 case was affirmed. “Here, to the extent that the tip forecasted that Defendants would recover a gun from a bedroom in the apartment, it was corroborated. Standing alone, this may not have been enough corroboration to support probable cause, but Defendants reasonably could have considered it in conjunction with the other facts available to them.” Roberts v. Azize, 2019 U.S. App. LEXIS 12665 (2d Cir. Apr. 25, 2019).*
