NY1: Even if the SW was overbroad, the remainder seized all supports the conviction

“Even assuming that the warrant’s authorization for the seizure and search of cell phones and other electronic devices was somewhat overbroad, the balance of the warrant, pursuant to which evidence implicating defendant in two of the charged robberies was recovered, was not invalidated ….” People v. Penn, 2018 NY Slip Op 06179, 2018 N.Y. App. Div. LEXIS 6134 (1st Dept. Sep. 25, 2018).* Harmless error without saying it.

Defendant waived his right to appeal in his prosecution, and that forecloses this appeal. People v. Ortiz, 2018 NY Slip Op 06199, 2018 N.Y. App. Div. LEXIS 6148 (1st Dept. Sep. 26, 2018).*
