OH5: Stop became unreasonable where officer extended stop 13 minutes and never started on ticket for failure to signal

The trial court suppressed because the stop was overly extended. Defendant was stopped for alleged failure to signal, and it dragged on for 13 minutes without the officer ever starting on writing a ticket. Conceding the stop was likely valid, the trial court suggested it was pretextual. “Nothing observed by any of the officers warranted detaining Lewis beyond the unproductive search of his vehicle. His continued detention beyond the vehicle search was not based on any articulable facts giving rise to a suspicion of some illegal activity justifying an extension of the detention, and thus was an illegal seizure.” State v. Lewis, 2018-Ohio-3681, 2018 Ohio App. LEXIS 3962 (5th Dist. Sep. 13, 2018).
