In this § 1983 case there was probable cause for issuance of an animal abuse warrant. To argue the probable cause was tainted by omission of information, plaintiff carries the burden, and here she failed. Kanciper v. Lato, 2017 U.S. App. LEXIS 24487 (2d Cir. Dec. 5, 2017).
Even though defendant’s arrest was held invalid, he’s not entitled to equitable expungement, following seven other circuits. United States v. Mettetal, 2017 U.S. App. LEXIS 24449 (4th Cir. Dec. 4, 2017).*
