CA2: Def’s attempted flight from a stop added to the RS

Officers were on a drug stakeout and saw the defendant watching the street, although there were no cars. He went in a building and came out with a plastic bag with a brick shaped object in the bottom. Officers tried to stop him and he kept going for 5-8 minutes. That heightened their reasonable suspicion. Seizure of defendant’s cell phones in the house without a warrant was reasonable in the murder for hire part of the case and there was no search of the cell phones without a search warrant. United States v. Babilonia, 2017 U.S. App. LEXIS 6515 (2d Cir. April 17, 2017).
