LA5: Adult grandson lived with grandmother; she could consent to his room because he didn’t pay rent

Defendant lived with his grandmother, but he didn’t pay rent. He was arrested and taken away, and she consented to a search of his room. “[T]he consenting party, Ms. Gant, was the sole owner of the property subject to the search. Ms. Gant herself testified that Defendant did not pay rent, although he had been living at the trailer for years. Therefore, Ms. Gant was the type of co-occupant who could have consented to the search of the property.” State v. Gant\, 2016 La. App. LEXIS 2425 (La.App. 5 Cir. Dec. 28, 2016).

On post-conviction, the motion to suppress not filed wouldn’t be granted because it was a private search by a store owner. State v. Watts, 2016-Ohio-8318, 2016 Ohio App. LEXIS 5173 (8th Dist. Dec. 22, 2016).*
