OH10: Failing to raise suppression issue at trial court was waived for appeal

Defendant waived his argument related to a prolonged detention by failing to raise it in his motions to suppress or at the suppression hearings, and then only by raising the argument for the first time on appeal. State v. Geiger, 2016-Ohio-7571, 2016 Ohio App. LEXIS 4442 (10th Dist. Nov. 1, 2016).

The trial court properly credited the testimony of the officer that he observed defendant’s lane change violation before the video would have preserved it, and there was thus reasonable suspicion for the stop. State v. Hahn, 2016-Ohio-7585, 2016 Ohio App. LEXIS 4453 (9th Dist. Nov. 2, 2016).*

Another Playpen warrant upheld. United States v. Scarbrough, 2016 U.S. Dist. LEXIS 141373 (E.D. Tenn. Aug. 26, 2016),* adopted, 2016 U.S. Dist. LEXIS 140549 (E.D. Tenn. Oct. 11, 2016).*
