OH10: Leaving house to go to drug deal and returning there was nexus to house

Nexus to defendant’s house for a drug search warrant is shown by the fact that he returned to the house immediately after a drug transaction [what does that prove? Most people go home after work] and left the house to go to the drug transaction [yes in reverse order; leaving to go to a drug transaction suggests more]. The CI also connects the house to drugs. State v. Phillips, 2016-Ohio-5944, 2016 Ohio App. LEXIS 3785 (10th Dist. Sept. 22, 2016).

Despite plaintiff’s acquittal in a conspiracy case, there was always probable cause to believe that he was involved in it, and that precludes summary judgment for malicious prosecution. Zargari v. United States, 2016 U.S. App. LEXIS 17329 (11th Cir. Sept. 22, 2016).
