OR: Hot pursuit justified entry into def’s garage to arrest for DUI

Defendant fled from police who were attempting to stop him for DUI, and he entered the garage. The officer lawfully entered the garage in hot pursuit because of defendant’s flight. State v. Wright, 280 Ore. App. 259, 2016 Ore. App. LEXIS 1004 (Aug. 17, 2016).

A baggie seen during a traffic stop in a car that was near defendant, but not within his line of sight, did not give probable cause to search the car for heroin. State v. Keller, 280 Ore. App. 249, 2016 Ore. App. LEXIS 1001 (Aug. 17, 2016).* [This case seems to be Oregon specific.]
