Nexus: Drug dealer’s homes usually have the stash

Nexus to defendant’s house for a drug search warrant was established by his leaving his house to do drug deals then coming right home. It’s common for drug dealers to keep their stash at home. State v. Hogan, 2014 Tenn. Crim. App. LEXIS 998 (November 3, 2014). To the same effect: United States v. Lawrence, 2014 U.S. Dist. LEXIS 155826 (W.D. Pa. November 3, 2014) with a more detailed explanation.

The witness’s grand jury testimony wasn’t inconsistent with the affidavit for search warrant, so a Franks hearing is not required. It also doesn’t affect the finding of probable cause. United States v. Ealy, 2014 U.S. Dist. LEXIS 155277 (S.D. Ohio November 3, 2014).*
