NC: ABC license permitted search of attached residence accessible directly by a door

Defendant’s home was attached to his liquor store, and ABC officers were permitted under their inspection power to inspect the residence as well which was accessible merely through a door. Inside the residence they could smell marijuana. One room of the residence defendant’s wife wouldn’t consent to further search, so they properly froze the premises to get a search warrant. Drugs were found and admissible. State v. Allah, 2014 N.C. App. LEXIS 968 (September 2, 2014).

Defendant was a suspect in a sexual assault, and he was arrested at home. The officers offered to let him smoke a cigarette before they took him away, just so they could get DNA from the butt. He smoked and the officer offered to dispose of the butt and defendant handed it to him. It was thus abandoned. State v. Borders, 2014 N.C. App. LEXIS 975 (September 2, 2014).
