Cal.1: Possession of a felt tip marker not a crime without intent to graffitiize

Possession of a felt tip marker is not per se illegal as possession of graffiti tools. Intent to graffitiize still has to be required. The juvenile’s arrest was without probable cause. In re S.F., 224 Cal. App. 4th 1575 (1st Dist. February 25, 2014), Published March 26, 2014.

Defense counsel couldn’t be ineffective for not requesting a Franks hearing where defendant admits he consented to a search. His motion to continue and change counsel after the jury had been sworn was properly denied. Francois v. State, 2014 Fla. App. LEXIS 5546 (Fla. 3d DCA April 16, 2014).*

On a stop for speeding, reasonable suspicion developed that marijuana was in the car justifying extending the stop. United States v. Robertson, 2014 U.S. Dist. LEXIS 53358 (M.D. La. April 17, 2014).*
