LA and abandonment on approach of the police

Defendant’s discarding of a cigarette box as officers walked up to him occurred prior to any illegal conduct of the police, so it was an abandonment. State v. Parks, 977 So. 2d 1015 (La. App. 5th Cir. 2008), released for publication April 4, 2008.*

In a similar case, officers observed defendant and another in a high crime area drop a paper cup on the ground, so they approached him for possible littering, and he ran and abandoned property. The seizure was valid. State v. Cummings, 977 So. 2d 135 (La. App. 5th Cir. 2008).*
