S.D.Fla.: Co-def’s winning suppression motion shows IAC for this defendant

Defendant satisfied his burden of proof that defense counsel was ineffective because his codefendant prevailed on his motion to suppress. If he’d timely moved to set aside the plea it would have almost certainly been granted. Perez v. United States, 2018 U.S. Dist. LEXIS 190010 (S.D. Fla. Nov. 7, 2018).

Defendant was detained during a search of the premises per Muehler v. Mena, and his statement he was the only person living in the house was not the product of a custodial interrogation. United States v. Arrington, 2018 U.S. Dist. LEXIS 190266 (S.D. Ohio Nov. 7, 2018).*
