IN: Recording a recording off a Facebook account doesn’t violate the federal wiretap law

Defendant was accused of breaking into his ex-girlfriend’s apartment and stealing her work iPad and other personal things. She signed on to his Facebook account with a password he’d previously given her. She found a recording there which admitted he had the iPad. Her recording the recording did not violate the federal wiretap law. Sparks v. State, 2018 Ind. App. LEXIS 139 (Apr. 18, 2018).

Defendant fled from a vehicle in a red jacket. When he was finally apprehended, he wasn’t wearing it. Officers found it, and it’s abandoned property. State v. Smith, 2018-Ohio-1444, 2018 Ohio App. LEXIS 1588 (3d Dist. Apr. 16, 2018).*
