TX13: The natural dissipation of alcohol in the blood alone is not exigency for a warrantless taking of blood

The natural dissipation of alcohol in the blood alone is not exigency for a warrantless taking of blood. State v. Ruiz, 2018 Tex. App. LEXIS 302 (Tex. App. – Corpus Christi – Edinburg Jan. 11, 2018).

Defendant didn’t object to the search of his wallet when he was detained, so the state never was on notice to make a record. Thus, the argument is waived. People v. Sankara, 2018 NY Slip Op 00224, 2018 N.Y. App. Div. LEXIS 223 (1st Dept. Jan. 11, 2018).*
