N.D.N.Y. When def failed to report to parole, his parole didn’t expire and a parole search could still occur

Defendant was delinquent in reporting, and his parole otherwise had expired, but the state parole law considered him still subject to their control for not reporting. Thus, the parole search could occur after the nominal expiration of parole because he hadn’t been discharged. Defendant doesn’t get a hearing because the facts are not in dispute. United States v.
