Search of a pill bottle found during a patdown for arrest for no DL was permissible under state constitution, and the court of appeals is reversed. Garcia v. State, 2016 Ind. LEXIS 30 (Jan. 21, 2016), rev’g 25 N.E.3d 786 (Ind. App. 2015).

Police had cause to search defendant’s car because of the “overpowering” smell of burning marijuana. It was permissible to open a notebook to see if marijuana was inside. United States v. Simmons, 2016 U.S. Dist. LEXIS 8086 (W.D.N.Y. Jan. 22, 2016).*
