CBS News: Innocent man arrested, jailed twice because of name

OLIVEHURST, Calif. — Two times, Gilberto Hernandez has been arrested and thrown in jail for crimes he didn’t commit — crimes that were allegedly committed by another man, who, to Hernandez’s dismay, shares his name.

That’s a good § 1983 case if the personal identifiers weren’t checked. I’ve settled a few and won one in a federal trial. That man was strip searched and jailed for two days before they checked the identifiers. He was 21. The man in the warrant was 43.
