FL2: Old information doesn’t corroborate a CI; no GFE

Search warrant affidavit failed to show probable cause and nexus. The attempted corroboration of the CI was with old information that proved really nothing. The good faith exception does not apply because no reasonable officer could rely on this search warrant with old information as corroboration. Sanchez v. State, 2011 Fla. App. LEXIS 21401 (Fla. 2d DCA July 23, 2014) [note year citation error].

Police conducted an unlawful sweep of defendant’s house, but the search warrant issued an hour later mentioned nothing of the sweep, and it was based entirely on separate information already known. Therefore, the search warrant was valid. Davila v. State, 2014 Tex. App. LEXIS 7912 (Tex. App. – Houston (1st Dist.) July 22, 2014).*
