BLT: D.C. Magistrate Judge Sets Up Showdown Over Cellphone Data by Zoe Tillman:

The federal government’s demand for cell site location data ‘raises serious statutory and constitutional questions,’ a federal magistrate judge said Friday in declining to rule on a recent application without first seeking input from prosecutors and a civil liberties group….He posed a series of questions about how cell site location information works and what information the government actually receives when it submits these types of applications. He appointed the Electronic Frontier Foundation, which has argued in favor of requiring prosecutors to show probable cause, to also respond to the same questions as an amicus.
