CA9: No immunity for special prosecutor and sheriff for newspaper executives’ raid for lack of PC

Special prosecutor and Sheriff Arpaio did not have immunity under the allegations of the complaint for a late night raid and arrests of an alternative newspaper’s executives allegedly without probable cause. The CI was new but corroborated, and defendant’s arrest was with probable cause. United States v. Exum, 2011 U.S. Dist. LEXIS 60240 (E.D. Mo. April 28, 2011).*
