NY: Stop for loud music permitted DL check

Defendant was stopped for playing music too loudly. A DL check showed that his license was suspended. The stop and running his license was valid. People v Tolentino, 2010 NY Slip Op 2643, 14 N.Y.3d 382, 926 N.E.2d 1212, 900 N.Y.S.2d 708 (2010).*

Information from a known CI and another officer formed the basis of defendant’s stop for DUI, and it was not unreasonable. State v. Lockhart, 2010 Tenn. Crim. App. LEXIS 253 (March 24, 2010).*

Probable cause to seize cash came from defendant’s differing stories of the source of the funds, the packaging in Ziploc bags, and the odor of drugs. State v. Property Seized from Martin, 2010 La. App. LEXIS 443 (1st Cir. March 30, 2010).*
