CA11: Def abandoned his cell phone and property in the building he moved out of and never came back for it

Defendant was held to have abandoned his cell phone by leaving it behind when he moved and making no effort to retrieve it and many other belongings. United States v. Gregg, 2019 U.S. App. LEXIS 13874 (11th Cir. May 9, 2019).

Hearsay from a search warrant affidavit could be considered in defendant’s sentencing. State v. McClanahan, 2019-Ohio-1802, 2019 Ohio App. LEXIS 1882 (2d Dist. May 10, 2019).*

The question of the legality of a search for a weapon in defendant’s case was mooted by and made harmless by his acquittal on charges related to it. He was convicted of forgery. State v. Allen, 2019-Ohio-1797, 2019 Ohio App. LEXIS 1877 (2d Dist. May 10, 2019).*
