Defendant doesn’t show that the officer’s waving his hand near the car was a handler cue to the dog. It was part of the dog training. The stop wasn’t unreasonably extended because defendant wasn’t answering questions, and he even produced a Homeland Security badge. The amount of time was reasonable spent attempting to dispel reasonable suspicion. United States v. Shen, 2017 U.S. Dist. LEXIS 83559 (N.D. Tex. June 1, 2017).
