Probable cause gathered by a Texas city officer outside of his city (thus jurisdiction) is not subject to suppression under the state suppression statute, Tex. Code Crim. P. Art. 38.23. Halili v. State, 2014 Tex. App. LEXIS 4456 (Tex. App. – Houston (14th Dist.) April 24, 2014).*
Roving border stop 45 miles north of the Mexican border was with reasonable suspicion. “The reasonable suspicion factors here included: (1) the stop location’s characteristics, including proximity to the border; (2) traffic patterns on the road; (3) Ms. Westhoven’s travelling during the border patrol shift change; and (4) Ms. Westhoven’s driving behavior and vehicle characteristics.” United States v.
