OH5: Warrantless probation search can include cell phones

A warrantless probation search can include the probationer’s cell phone as his “property.” State v. Kelley, 2014-Ohio-464, 2014 Ohio App. LEXIS 455 (5th Dist. February 4, 2014). [Defense lawyers: Think of all your clients carrying their cell phones to PO meetings.]

Defendant was arrested on warrants and needed clothes to go to jail and consented to the officers coming into the house to observe. Plain view sustained. [Just like Washington v. Chrisman which isn’t cited.] State v. Dean, 2014-Ohio-448, 2014 Ohio App. LEXIS 447 (12th Dist. February 10, 2014).*
