Privacy activists and others opposed to the NSA’s surveillance of Americans contend it has broken the law and breached the Fourth Amendment, but the issue is not necessarily quite that clear. “I’m not sure if ‘has the NSA broken the law?’ is the right question to ask,” said Brian Pascal, a research fellow at UC Hastings College of the Law. “To me, the question is, ‘how effective has the oversight been?'”
