D.Vt.: PC shown for DNA sample in kidnapping case

Defendant is charged with kidnapping of a minor across state lines and interstate transportation of a stolen vehicle. The government showed probable cause and particularity for defendant’s DNA to further link him to the crime. United States v. Simpson, 2019 U.S. Dist. LEXIS 212692 (D.Vt. Dec. 10, 2019).*

“Plaintiff’s complaint alleges that defendants violated his federal constitutional [Fourth Amendment] and other rights in the course of a prior civil suit which the United States brought against him on behalf of the Internal Revenue Service (IRS) for failure to pay federal income taxes.” He sued in state court in Ohio, and the government properly removed the case to federal court for federal question jurisdiction. The motion to remand is denied. Steele v. United States, 2019 U.S. Dist. LEXIS 212717 (S.D. Ohio Dec. 10, 2019).*
