Juvenile adjudications can support taking DNA for CODIS

Qualifying juvenile adjudications are constitutionally subject to the taking of DNA samples for CODIS. Petitioner F v. Brown, 2008 Ky. App. LEXIS 42 (February 22, 2008).

Officer’s experience in child porn investigations was sufficient for probable cause that the persons in the pictures were minors. United States v. Davila-Sanchez, 2008 U.S. Dist. LEXIS 13115 (D. P.R. February 21, 2008).*

While the use of the drug dog in this case was delayed somewhat, defendant’s log book violation would have kept him from driving anyway, and that mitigated the delay. Also, there is no prohibition from vehicle enforcement officers using drug dogs in truck stops. Meghoo v. Commonwealth, 245 S.W.3d 752 (Ky. 2008).*
