SD: Taxidermy a highly regulated industry under Burger

The business of taxidermy is highly regulated in South Dakota and has been for 85 years. It satisfies the Burger test. The records inspection here was during normal business hours and did not require a search warrant. State v. Klager, 2011 SD 12, 797 N.W.2d 47 (2011):

[*P21] With respect to the second criterion, at oral argument, Klager conceded that warrantless inspections are necessary to further taxidermy regulation. He must concede the point as the record reflects that because of illegal harvesting, trafficking, and possession of wildlife, unannounced inspections are crucial to effective enforcement of the regulatory scheme.

In a case involving a woman accused of sexually abusing young boys, the search warrant was for sex toys. Officers also knew about contraceptives from interviews. While the search warrant did not include everything seized, once the officers were there, things described by the boys were found, and the “immediately apparent” prong of plain view was satisfied. Granger v. State, 946 N.E.2d 1209 (Ind. App. 2011).*
