OH8: Unmarked car can make a traffic stop

Under Ohio law, an unmarked police car can make a traffic stop. And, it’s not like defendant didn’t know because the car had lights and siren and the officers were in uniform and he stopped. State v. Taylor, 2011 Ohio 1554, 2011 Ohio App. LEXIS 1346 (8th Dist. March 31, 2011).*

The mere fact defense counsel allegedly failed to look at the search warrant and make a determination whether it was defective is not itself IAC. Defendant showed no prejudice that any suppression motion would have been resolved in his favor. State v. Lenard, 2011 Ohio App. LEXIS 1350 (8th Dist. March 31, 2011).*

The gun seen in defendant’s back seat was in plain view with a flashlight. State v. Jimenez, 2011 Ohio 1572, 2011 Ohio App. LEXIS 1327 (8th Dist. March 31, 2011).*
