CA5: GFE wasn’t raised or litigated below so it’s not considered on appeal

The district court’s findings on the search were not clearly erroneous. The good faith exception wasn’t raised in the district court, and not on appeal so it’s waived. United States v. Taylor, 2019 U.S. App. LEXIS 14644 (5th Cir. May 17, 2019).

Defendant’s state court search claim was litigated and lost, but he challenged on habeas his counsel’s failure to properly litigate it. He doesn’t say how or what the other theory was. Mell v. Skipper, 2019 U.S. Dist. LEXIS 83262 (E.D. Mich. May 17, 2019).*

Plaintiff’s § 1983 case over his search is barred by Younger because the state case is ongoing. Dickerson v. Youngblood, 2019 U.S. Dist. LEXIS 83824 (E.D. Cal. May 17, 2019).*
