The Policy Statement number coincides with the Code of Federal Regulations section number.<\/p>\n<p><strong>The inmate search<\/strong> regulation is <a href=\"http:\/\/www.bop.gov\/policy\/progstat\/5521_005.pdf\">Program Statement 5521.05<\/a> (June 30, 1999) (.pdf).  This is implemented under 28 C.F.R. \u00a7 552.10:<\/p>\n<blockquote><p>\u00a7 552.10 Purpose and scope. <\/p>\n<p>In order to further the safe, secure, and orderly running of its institutions, the Bureau of Prisons conducts searches of inmates and of inmate housing and work areas to locate contraband and to deter its introduction and movement. Staff shall employ the least intrusive method of search practicable, as indicated by the type of contraband and the method of suspected introduction.<\/p><\/blockquote>\n<p>The CFRs for all &#8220;custody&#8221; relationships are <a href=\"http:\/\/www.access.gpo.gov\/nara\/cfr\/waisidx_06\/28cfr552_06.html\">here<\/a>.<\/p>\n<p>They include the following:<\/p>\n<p><a href=\"http:\/\/a257.g.akamaitech.net\/7\/257\/2422\/01jul20061500\/edocket.access.gpo.gov\/cfr_2006\/julqtr\/pdf\/28cfr552.11.pdf\">\u00a7 552.11<\/a>: Body searches<\/p>\n<p><a href=\"http:\/\/a257.g.akamaitech.net\/7\/257\/2422\/01jul20061500\/edocket.access.gpo.gov\/cfr_2006\/julqtr\/pdf\/28cfr552.12.pdf\">\u00a7 552.12<\/a>: Close observation<\/p>\n<p><a href=\"http:\/\/a257.g.akamaitech.net\/7\/257\/2422\/01jul20061500\/edocket.access.gpo.gov\/cfr_2006\/julqtr\/pdf\/28cfr552.13.pdf\">\u00a7 552.13<\/a>:  X-ray, major instrument, fluoroscope, or surgical intrusion<\/p>\n<p><a href=\"http:\/\/a257.g.akamaitech.net\/7\/257\/2422\/01jul20061500\/edocket.access.gpo.gov\/cfr_2006\/julqtr\/pdf\/28cfr552.14.pdf\">\u00a7 552.14<\/a>: Search of inmate housing and work areas [Note: &#8220;Tossing&#8221; the cell is inappropriate. Policy Statement \u00b6 9(b) &#8220;Staff conducting the search shall leave the housing or work area as nearly as practicable in its original order.&#8221;]<\/p>\n<p><strong>Search of visitors<\/strong> is <a href=\"http:\/\/www.bop.gov\/policy\/progstat\/5267_008.pdf\">Program Statement \u00a7 5267.08<\/a> (May 11, 2006).  This is implemented under 28 C.F.R. \u00a7 540.40:<\/p>\n<blockquote><p>\u00a7 540.40.  Purpose and scope.<\/p>\n<p>The Bureau of Prisons encourages visiting by family, friends, and community groups to maintain the morale of the inmate and to develop closer relationships between the inmate and family members or others in the community. The Warden shall develop procedures consistent with this rule to permit inmate visiting. The Warden may restrict inmate visiting when necessary to ensure the security and good order of the institution.<\/p>\n<p>\u00a7 540.41  Visiting facilities.<\/p>\n<p>The Warden shall have the visiting room arranged so as to provide adequate supervision, adapted to the degree of security required by the type of institution. The Warden shall ensure that the visiting area is as comfortable and pleasant as practicable, and appropriately furnished and arranged. If space is available, the Warden shall have a portion of the visiting room equipped and set up to provide facilities for the children of visitors.<\/p>\n<p>(a) Institutions of minimum and low security levels may permit visits beyond the security perimeter, but always under supervision of staff.<\/p>\n<p>(b) Institutions of medium and high security levels, and administrative institutions may establish outdoor visiting, but it will always be inside the security perimeter and always under supervision of staff.<\/p><\/blockquote>\n<p>The rule on <a href=\"http:\/\/a257.g.akamaitech.net\/7\/257\/2422\/01jul20061500\/edocket.access.gpo.gov\/cfr_2006\/julqtr\/pdf\/28cfr540.46.pdf\">attorney visits<\/a> was last revised in 2003:<\/p>\n<blockquote><p>\u00a7 540.46  Attorney visits.<\/p>\n<p>Requirements for attorney visits are governed by the provisions on inmate legal activities (see \u00a7\u00a7 <a href=\"http:\/\/a257.g.akamaitech.net\/7\/257\/2422\/01jul20061500\/edocket.access.gpo.gov\/cfr_2006\/julqtr\/pdf\/28cfr543.12.pdf\">543.12<\/a> through <a href=\"http:\/\/a257.g.akamaitech.net\/7\/257\/2422\/01jul20061500\/edocket.access.gpo.gov\/cfr_2006\/julqtr\/pdf\/28cfr543.16.pdf\">543.16<\/a> of this chapter).
