The claim that the judge did not read the search warrant affidavit is speculative without more, aside from the question of judicial immunity for signing a search warrant. <a href=\"http:\/\/media.ca7.uscourts.gov\/cgi-bin\/rssExec.pl?Submit=Display&amp;Path=Y2013\/D04-10\/C:12-3467:J:PerCuriam:aut:T:npDp:N:1116482:S:0\">Avery v. Kratz<\/a>, 522 Fed. Appx. 361 (7th Cir. 2013).<\/p>\n<p>Defendant was under investigation starting in October 2009 for obtaining child pornography via a peer to peer network. Months later, a state subpoena was used to get subscriber information, allegedly in violation of state law. Months after that, defendant was stopped and consented to a search for drugs. The officer involved in that stop knew nothing of the CP investigation. Defendant consented to a computer search for drug transaction evidence, and the officer stumbled on the CP, shut the computer down, and acquired a search warrant. The search of the computer is similar to and governed by  United States v. Hudspeth, 459 F.3d 922 (8th Cir. 2006), rev&#8217;d in part on other grounds, 518 F.3d 954 (8th Cir. 2008) (en banc). The alleged violation of state law in the issuance of the subpoena does not govern the Fourth Amendment analysis, and it was done reasonably. <a href=\"http:\/\/www.ca8.uscourts.gov\/opndir\/13\/04\/122885P.pdf\">United States v.
