{"id":7442,"date":"2012-07-18T12:38:19","date_gmt":"2012-07-18T05:22:58","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2012-07-18T05:22:58","slug":"en-US","status":"publish","type":"post","link":"https:\/\/fourthamendment.com\/?p=7442","title":{"rendered":"LawFare: &#8220;Whole Body Scanners, the Fourth Amendment, and the Administrative Procedures Act&#8221;"},"content":{"rendered":"<p>LawFare: <a href=\"http:\/\/www.lawfareblog.com\/2012\/07\/whole-boddy-scanners-the-fourth-amendment-and-the-administrative-procedures-act\/\">Whole Body Scanners, the Fourth Amendment, and the Administrative Procedures Act<\/a> by Paul Rosenzweig:<\/p>\n<blockquote><p>Whole body scanners (also known as Advanced Imaging Technology or AIT) are those new millimeter wave and backscatter scanners that the Department of Homeland Security is deploying in airports around the country \u2014 what some people call the \u201cnaked machine.\u201d  Today, the efforts of some to have the scanners removed took an interesting turn \u2014 with this mandamus petition filed by the Electronic Privacy and Information Center.<\/p>\n<p>DHS began the deployment of AIT scanners in earnest in the aftermath of the failed Christmas bomb plot a couple of years ago.  The government asserted that the scanners were safe and that their new imaging technology would assist in detecting bomb threats to aviation.
