Because defendant appeared nervous, the officer frisked him for officer safety. The frisk was unlawful for a stop for something that wasn\u2019t even an offense. Mistake of law will not support a stop. <a href=\"http:\/\/mdcourts.gov\/opinions\/cosa\/2012\/2744s09.pdf\">Gilmore v. State<\/a>, 204 Md. App. 556, 42 A.3d 123 (2012).<\/p>\n<p>Plaintiff\u2019s claim that her arrest was without probable cause or qualified immunity is sustained, and the district court properly granted summary judgment for her. That an arrest without probable cause is unconstitutional is well established. <a href=\"http:\/\/pacer.ca4.uscourts.gov\/opinion.pdf\/111392.P.pdf\">Merchant v.
