Since this arrest was custodial, the vehicle was improperly impounded because it was lawfully parked and the officer made no effort to see if the passenger would drive the vehicle, thus obviating impoundment. <a href=\"http:\/\/www.lexisone.com\/lx1\/caselaw\/freecaselaw?searchType=citation&amp;fclSearch=2012+Ga.+App.+LEXIS+252&amp;action=FCLSearchCaseByCitation&amp;pageLimit=10&amp;format=CITE&amp;pageNumber=1&amp;sourceID=&amp;citation=2012+Ga.+App.+LEXIS+252&amp;searchTerm=\">Canino v. State<\/a>, 314 Ga. App. 633, 725 S.E.2d 782 (2012).*<\/p>\n<p>A visitor to a house ran the risk that the host would consent to admitting the police who came in and saw the visitor\u2019s suitcase and seized it. The police got a search warrant for the seized suitcase on probable cause. <a href=\"http:\/\/www.ca3.uscourts.gov\/opinarch\/103858np.pdf\">United States v. Cruz<\/a>, 2012 U.S. App. LEXIS 4986 (3d Cir.
