{"id":6767,"date":"2012-07-15T18:12:45","date_gmt":"2012-03-04T00:02:04","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2012-03-03T07:57:03","slug":"en-US","status":"publish","type":"post","link":"https:\/\/fourthamendment.com\/?p=6767","title":{"rendered":"WA: No expectation of privacy in a bar&#8217;s public area"},"content":{"rendered":"<p>A bar had no reasonable expectation of privacy in the public area of its establishment under <a href=\"http:\/\/scholar.google.com\/scholar_case?case=11785638731606285522&amp;q=barlow%27s&amp;hl=en&amp;as_sdt=20002\">Barlow\u2019s<\/a>. \u201cEven if, as Dodge City argues, it had a subjective reasonable expectation of privacy to exclude persons under 21 years old, which it did not, Dodge City lost that interest when it voluntarily admitted [the minor] onto the premises.\u201d Dodge City Saloon, Inc. v. Liquor Control Bd., 166 Wn. App. 828, 271 P.3d 363 (2012). <\/p>\n<p>Just because a judge denies a motion to suppress does not mean that the judge is biased against the defendant. United States v. Harris, 2012 U.S. Dist. LEXIS 26578 (W.D. Mo. January 24, 2012).*<\/p>\n<p>In an Anders brief, the search warrant was valid. <a href=\"http:\/\/www.fifthcircuit.org\/PDF\/OPINIONS\/PO\/2012\/B2604C8E-21AC-4788-8F3C-9CCC01CB8069.pdf\">State v. Jones<\/a>, 88 So. 3d 1120 (La. App. 5th Cir. 2012).*<\/p>\n<p>Here the officers had an arrest warrant for defendant and performed a \u201cprotective sweep\u201d to corral the children in the house so they would be attended to when the officers left with defendant. This was reasonable. Defendant consented to retrieving his ID from the bedroom and the seizure of his cell phones. United States v. Rivero, 2012 U.S. Dist. LEXIS 26867 (N.D. Ga.
