{"id":6409,"date":"2011-12-27T05:31:28","date_gmt":"2011-12-15T07:38:58","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2011-12-15T07:38:58","slug":"en-US","status":"publish","type":"post","link":"https:\/\/fourthamendment.com\/?p=6409","title":{"rendered":"Today is Bill of Rights Day"},"content":{"rendered":"<p><a href=\"http:\/\/www.billofrightsday.com\/\">The 220th anniversary of the ratification of the Bill of Rights<\/a>. Bill of Rights Day was <a href=\"http:\/\/en.wikipedia.org\/wiki\/United_States_Bill_of_Rights\">designated in 1941<\/a>, seven days after the declaration of war in WWII. They weren&#8217;t adopted overnight&#8211;they were <a href=\"http:\/\/en.wikipedia.org\/wiki\/United_States_Bill_of_Rights\">referred to the thirteen states 27 months earlier<\/a>. [Update: <a href=\"http:\/\/www.cato.org\/us-constitution\/\">see Cato.org<\/a>, too.]<\/p>\n<p>Still, too few people even recognize the Bill of Rights (<a href=\"http:\/\/www.nytimes.com\/1991\/12\/15\/us\/poll-finds-only-33-can-identify-bill-of-rights.html\">1991 here<\/a> and <a href=\"http:\/\/www.archives.gov\/publications\/prologue\/2005\/winter\/weinstein.html\">1998 here<\/a>). This is remarkable, except when one considers the United States is interested in spreading democracy abroad while most of its own citizens do not understand its fundamental documents.<\/p>\n<p>Look at the members of state legislatures and <a href=\"http:\/\/fourthamendment.com\/blog\/index.php?blog=1&amp;title=huffpo_gop_jobs_bill_slashes_benefits_al&amp;more=1&amp;c=1&amp;tb=1&amp;pb=1\">Congress<\/a> so willing to give up Fourth Amendment rights of all in the name of some expediency, be it fighting terrorism or drug testing recipients of government funds. This is the misguided belief that others losing Fourth Amendment rights doesn&#8217;t mean anything as to the country as a whole. As to the recipients of government funds, there is no indication of a problem, but that doesn&#8217;t stop legislators (see posts <a href=\"http:\/\/fourthamendment.com\/blog\/index.php?blog=1&amp;title=ga_legislator_proposes_drug_testing_of_w&amp;more=1&amp;c=1&amp;tb=1&amp;pb=1\">here<\/a>, <a href=\"http:\/\/fourthamendment.com\/blog\/index.php?blog=1&amp;title=gop_finds_drug_testing_compassionate_thi&amp;more=1&amp;c=1&amp;tb=1&amp;pb=1\">here<\/a>, <a href=\"http:\/\/fourthamendment.com\/blog\/index.php?blog=1&amp;title=some_indiana_legislators_want_to_drug_te&amp;more=1&amp;c=1&amp;tb=1&amp;pb=1\">here<\/a>). I remember one state legislator saying that his <a href=\"http:\/\/www.dispatch.com\/content\/stories\/local\/2011\/12\/01\/welfare-drug-test-debate-rekindled.html\">constituents<\/a> &#8220;really wanted&#8221; this. Why don&#8217;t we just get over it and drug test every recipient of government funds, starting with <a href=\"http:\/\/www.wptv.com\/dpp\/news\/state\/%27daily-show%27-reporter-aasif-mandvi-asks-gov.-rick-scott-to-pee-in-cup-during-budget-unveiling\">the Governor of Florida<\/a> down to all state legislators, <a href=\"http:\/\/www.huffingtonpost.com\/2011\/10\/14\/thom-tillis-welfare-drug-testing-north-carolina_n_1010878.html\">all government workers, welfare recipients<\/a>, government contractors, CJA lawyers, <a href=\"http:\/\/www.knoxnews.com\/news\/topic\/richard-baumgartner\/\">judges<\/a>, etc?<\/p>\n<p>Because we can&#8217;t under <a href=\"http:\/\/scholar.google.com\/scholar_case?case=6102826977251195448&amp;q=skinner&amp;hl=en&amp;as_sdt=2,44\">Skinner<\/a> and <a href=\"http:\/\/scholar.google.com\/scholar_case?case=9123832187759361431&amp;q=von+raab&amp;hl=en&amp;as_sdt=2,44\">Von Raab<\/a>, that&#8217;s why; and none of these clowns knows it because, while <a href=\"http:\/\/scholar.google.com\/scholar_case?case=182380462089618871&amp;q=110+us+619&amp;hl=en&amp;as_sdt=2,44\">legislators are presumed to know what the courts have said on an issue<\/a>, that only means that they are actively defying the Fourth Amendment, or just don&#8217;t care about the Constitution when it is the rights of somebody else, notwithstanding that destroying the rights of one can quickly lead to destroying the rights of all.<\/p>\n<p>Happy Bill of Rights Day.
