{"id":6245,"date":"2012-06-10T19:27:16","date_gmt":"2011-11-08T07:36:37","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2011-11-08T07:36:37","slug":"en-US","status":"publish","type":"post","link":"https:\/\/fourthamendment.com\/?p=6245","title":{"rendered":"TX2: State failed to show objective reasonable suspicion for detention"},"content":{"rendered":"<p>Based on the officer\u2019s testimony alone, the court finds that the stop was without objective reasonable suspicion, and the motion to suppress as a result of his detention should have been granted. <a href=\"http:\/\/www.2ndcoa.courts.state.tx.us\/opinions\/PDFopinion.asp?OpinionID=22800\">State v. Kerwick<\/a>, 353 S.W.3d 911 (Tex. App.\u2013Ft. Worth 2011).*<\/p>\n<p>Defense counsel fully litigated the motion to suppress and appealed it, so there was no IAC. United States v. Clay, 2011 U.S. Dist. LEXIS 128305 (E.D. Ark. November 4, 2011).*<\/p>\n<p>Testimony was submitted to a state trial judge for issuance of a search warrant, and the transcript of that application was submitted to the federal court in opposition to the motion to suppress. The court agrees that there was ample probable cause. United States v. Scott, 2011 U.S. Dist. LEXIS 128328 (D. N.D. November 4, 2011).*<\/p>\n<p>Officer\u2019s observations of a juvenile during a DWI arrest were not suppressible as \u201ctestimonial.\u201d <a href=\"http:\/\/www.nmcompcomm.us\/nmcases\/NMCA\/2011\/11ca-105.pdf\">State v. Randy J.<\/a>, 150 N.M. 683, 2011 NMCA 105, 265 P.3d 734 (2011), Certiorari Denied, 269 P.3d 903 (N.M. 2011).*<\/p>\n<p>Officer&#8217;s smell of marijuana during a stop with other factors was reasonable suspicion. <a href=\"http:\/\/www.judicial.state.sc.us\/opinions\/displayOpinion.cfm?caseNo=4872\">State v. Morris<\/a>, 2011 S.C.
